We undertake to comply with applicable data protection law, in particular with the provisions under the Bundesdatenschutzgesetz (BDSG [German Federal Data Protection Act]) and under the Telemediengesetz (TMG [German Telemedia Act]).

We collect, process and use your personal data only on the condition that you agreed to this or in cases where processing or using such data is admissible on the basis of legal provisions. In addition, we process or use only those personal data which are required for being able to use the website or those personal data which you submitted to us.

3. Processing and Usage of Your Personal Data

3.1. To the extent to which this is required, we collect, process and use all those Personal Data which you submitted to us when registering as a purchaser and/or seller and by providing information in your account on a voluntary basis for the purposes indicated in the following:

  • Registration Process and Execution of Brokerage Contracts:
    • Any Personal Data which you provide when creating your account, such as your name, e-mail address, phone number, mobile phone number, postal address, and when verifying your company (depending on the Services you intend to use);
    • For Sellers: Authorisations and identity evidence with respect to the Contents offered on the websites;
    • We also collect, process and use any transaction data relating to your activities on the websites (such as, including but not limited to, purchases, licences which you obtained, Contents which you offer as seller as well as your search behaviour and histories);
    • Invoice and other data which you provide for purchase and/or selling process purposes;
    • Data which are transmitted within the framework of community discussions, evaluations, chats and correspondence on the website or by e-mail/fax/letter;
    • Data which are created when executing any test purchases provided for on the basis of the General Terms and Conditions;
    • Connection and usage data of the GVC Download Client; and

To the extent to which users communicate to us any Personal Data for the purpose of establishing contact, these Personal Data will be stored for a period which is required for communication, customer contact as well as project planning/execution purposes. Once we no longer require any such Personal Data, we will delete them without undue delay.

3.2. In addition to the above, we also collect anonymous technical data, such as the name of your internet service provider, your internet browser, your operating system, your screen resolution as well as any information on the website which referred you to our website, the number and the exact times of your visits, the average period of time you spent on our website and the web pages you called off on our website. These data are automatically stored and they are analysed on an anonymised basis and exclusively for statistical purposes with the aim of continuing to enhance the website presentation for you.

4. Transfer of Your Data to Third Parties

4.1. As a general rule, Gulliveo does not transfer your Personal Data to any third party, unless you expressly agreed to this in advance or unless such transfer is required and/or admissible on the basis of the law. In particular, we will refrain from selling your Personal Data to any third parties and from marketing them in any other way. Personal Data will be transferred to government entities or public authorities exclusively within the framework of compulsory national legal provisions. We subject both our employees and our partners to a confidentiality obligation and to an obligation to comply with any and all applicable provisions according to data protection law.

For being able to use the PayPal payment services, we are obligated to transfer any data which are required for verifying your valid account, that is, your e-mail address as well as the given name and the family name of the account administrator. Once any such data were transferred to the payment service provider, their processing shall be subject to the data protection declaration established by such service provider.

4.3. Apart from the above, we will also transfer to the respective brokered service provider any and all required Personal Data after any processing services on the basis of our processing brokerage contracts were successfully brokered.

5. Cookies and Tracking
